Qualifications to stand as tenant representative

To be eligible to stand for election as a tenant representative you MUST:

a) Live in the area you wish to represent;

(for example, if you wish to be the tenant representative for Hucknall, you must live in  Hucknall,)

b) Be 18 years of age on the day of nomination; and

c) Be one of the following:-

(i) a tenant (including a joint tenant) of Ashfield District Council who holds a secure or introductory tenancy;  or

(ii) a Resident leaseholder, (a person who has bought an Ashfield District Council flat under the Right to Buy legislation) and live in the property on the day of nomination; or

(iii) someone who lives with a tenant of Ashfield District Council, and is the partner of/or an immediate family member of the tenant.  You must also have lived with the tenant at the property for a period of a least 12 months prior to the day of nomination.

Note:

Immediate family means you are the tenant’s parent, grandparent, child, grandchild, brother or sister, and includes relationships by marriage, half blood and stepchild

Nomination form

Candidates submit a nomination form that must be signed and dated in the presence of a witness. The witness may be any person who knows the candidate, and should be 18 years of age or over.

Disqualification from standing as a tenant representative

a) You are a person who has been adjudged bankrupt, or made a composition or arrangement with creditors.

b) You (or if you are not the tenant) the tenant is in serious breach of the obligations as a tenant of Ashfield District Council.  The Chief Executive of Ashfield Homes Ltd will determine what constitutes a serious breach of tenancy obligations.

Election statement form

Each Candidate is required to make an election statement, which is sent to all the tenants voting in the election along with a ballot paper. The election statement would normally give a little background information about the candidate and why he or she is standing for election. The statement should be confined to tenant related matters and outline how the candidate would act with the best intentions in his/her capacity as both a tenant representative and a member of the Board.  It must not be a political statement or contain anything, which is malicious, libellous, or racially or sexually inflammatory.

Who can vote in the election?

All tenants, sole or joint, and resident leaseholders are eligible to vote in an election. Each elector will be allowed to vote only once in the election within the area in which they live. Where there is more than one nomination in each respective area, there will be an election in that area.

Election

In the event that there is only one candidate, subject to that candidate not being exempt from being a Board Member, they will automatically be declared the Tenant Board Member for the area they represent.

If no-one stands for election in an area then the Ashfield Federation of Tenants and Residents Associations will be asked to nominate a representative to the Board.

If there are two or more candidates, an election will be held to choose the tenant representatives.

The count and declaration of result

The Counting of votes is conducted by the Electoral Reform Services. The Declaration of the Results is made by the Chief Executive, Ashfield Homes Limited.
